1. Who we are
Sounds and Such (“we”, “us”) is an audiobook production business run by Dominic Benavides, doing business as Sounds and Such, an independent contractor (sole proprietor) based in Washington State, USA. For this website and the personal data described here, we are the “controller” (the party responsible for your data).
Questions or requests: hello@soundsandsuch.com
2. What we collect
Things you send us: your name, email address and anything else you put in our contact form or in emails to us, such as details about your book or project.
Newsletter signups: your email address when you sign up for our newsletter.
Client project files: manuscripts, scripts, audio recordings, finished audio files and related materials we exchange with you during a project.
Payment information: when you pay us by Zelle or bank transfer, we receive only what we need to match your payment: the payer’s name, the amount and the payment reference. We do not collect or store card details.
Website usage data: Squarespace, our hosting platform, collects information about your browser, network and device, the pages you visited before coming here, and your IP address. With your consent, we also collect analytics data about how visitors use the site.
3. How we use it, and our legal bases
Answering enquiries and preparing quotes: Steps you ask for before a contract, or our legitimate interest in responding to you
Producing your audiobook and exchanging files: Performing our contract with you
Receiving and matching payments: Performing our contract with you
Sending our newsletter: Your consent (you can withdraw it any time)
Running and securing the website: Our legitimate interest in a working, secure site
Site analytics: Your consent through the cookie banner
Keeping business records required by law: Legal obligation
We do not sell your personal information, and we do not share it for targeted advertising.
4. Cookies
This site uses cookies and similar technologies: small files or pieces of text stored on your device when you visit a website.
Required and functional cookies are always used. They let Squarespace serve the site to you securely.
Analytics and performance cookies (Squarespace Analytics) are only used if you accept them.
When you first visit, our cookie banner lets you Accept all, Decline all, or Manage your choices. You can change your choice at any time through the cookie banner or your browser settings. See the cookies Squarespace uses for details.
5. Who we share it with
We use these service providers (“processors”), who handle data only on our behalf:
Squarespace: website hosting, our contact form, site analytics, and our newsletter mailing list. Messages sent through the contact form are stored in Squarespace. Squarespace also uses visitor data to protect and improve its platform, and analyzes it in de-personalized form.
Proton Mail (Proton AG, Switzerland): email sent to hello@soundsandsuch.com is delivered to and stored in our Proton Mail inbox.
Google Drive: we keep a copy of our newsletter signup list in a Google Sheet.
Dropbox: shared folders where clients send us manuscripts and audio files, and where we deliver finished WAV files.
Zelle and our bank: payments made by Zelle or bank transfer are handled by Zelle and the banks involved, under their own privacy policies. We receive only the payer’s name, the amount and the payment reference.
Narrators. Clients send manuscripts and scripts to Dominic, who forwards them to the narrator assigned to the project. Narrators are independent contractors. They receive only the project materials they need to record your audiobook, and use them only for that project.
We also use Google Search Console and a Google Business Profile to understand how people find us in Google search. Search Console gives us summary search statistics, not information about individual visitors. If you leave a review or send a message through our Google Business Profile, Google’s own privacy policy applies to it.
We don’t currently use a separate email marketing service. In the future we may move our newsletter to a service such as MailerLite. If we do, we will update this policy.
We may also disclose data if the law requires it, or to protect our rights.
6. International transfers
The business is based in the United States. Squarespace, Google and Dropbox process data mainly in the United States, and Proton processes email in Switzerland. When personal data moves from the EEA, UK or Switzerland to the United States, we rely on the EU-U.S. Data Privacy Framework (and its UK and Swiss extensions) where the provider is certified, or on Standard Contractual Clauses.
7. How long we keep it
Newsletter: until you unsubscribe, after which your address is removed from our list.
Enquiries and quotes that don’t lead to a project: 2 years from our last contact.
Client project files (manuscripts, scripts and audio): up to 1 year after we deliver the finished files, so we can handle corrections or re-deliveries. After that we delete them.
Business and accounting records (such as invoices and payment records): 7 years, or longer if tax and accounting laws require it.
Analytics data: kept for the period set by Squarespace Analytics’ default settings.
8. Your rights
If you are in the EEA, UK or Switzerland, you have the right to:
see the personal data we hold about you and get a copy
have it corrected
have it deleted
restrict or object to how we use it, including for direct marketing
receive it in a portable format
withdraw consent at any time, without affecting earlier use
complain to your local data protection authority
Wherever you are, including the United States, you can ask us what personal information we hold about you, ask us to correct or delete it, and unsubscribe from our newsletter at any time. We will not treat you differently for making a request.
To make a request, email hello@soundsandsuch.com. We may need to confirm your identity first. We aim to reply within one month. You can also unsubscribe from our newsletter with the link at the bottom of each email.
9. Children
Our services are for publishers, agents and authors, and are not aimed at children under 16. We do not knowingly collect their personal data. If you think a child has given us personal data, contact us and we’ll delete it.
10. Changes to this policy
We may update this policy from time to time, for example if we start using a new service. The “Last updated” date at the top shows when it last changed. If the changes are significant, we’ll make that clear on the site.
